This chapter discusses how ERISA preempts this entire field of law and state laws are invalidated in most instances. Procedures for dealing with ERISA claims are also discussed. Companies are sometimes surprised by the breadth of ERISA, but can benefit from the discretion given to plan administrators in administering ERISA plans.
